Acceptance of the Privacy Policy

Your privacy is very important to us.  As a not-for-profit institution, our goal is to collect information about our users and their use of our services that will help provide the best online experience possible and implement Pure Flix’s mission.  

This Privacy Policy explains how we use, share and protect information that we collect from you online through PureFlix.com and any other websites, applications, our content on connected devices, interactive services, promotions or online services that Pure Flix operates, as well as off-line interactions with us that link to this Privacy Policy (collectively, the “Services”).   PureFlix.com is owned and operated by God’s Not Dead Foundation d/b/a Pure Flix, a Louisiana non-profit Corporation and approved IRS designated 501(c)(3) organization.

By accessing and using the Services, you agree to our collection and use of your information in the manner described in this Privacy Policy.  If you do not agree with the terms of this Privacy Policy you should not use our Services. Please note that this Privacy Policy includes embedded hyperlinks that may only be accessed through our website, so if you are reviewing this Privacy Policy through certain Pure Flix ready devices (for example game consoles or Internet enabled televisions), you may need to visit the website to review these hyperlinked terms.

1. Geographic Scope of the Privacy Policy

 

The Services are operated in the United States and are therefore governed by and operated in accordance with the laws of the United States.  If you are located outside of the United States, please be aware that the information you provide to us or that we obtain as a result of your use of the Services will be collected in the United States and/or transferred to the United States and will be subject to U.S. law.

By accessing and using the Services and/or providing us with information, you (a) consent to the transfer and/or processing of any information to and in the United States, (b) acknowledge that U.S. law may provide a lower standard of protection for information than the laws of your location, (c) understand that we will collect, transfer, store, process and share your information from or about you in accordance with this Privacy Policy and U.S. law.

2. Types of information we collect from or about you

Pure Flix collects information about you, and during your use of the Services, including, but not limited to, personal information (meaning information that identifies or allows us to contact a specific person or household, e.g. full name, physical address, telephone number, cell phone number or email address), and non-personal information that does not permit direct association with you.  Below we describe the different types of information we collect from you and from your use of the Services.

  • Information you provide to us:   When you sign up to receive emails from us, register for or subscribe to the Services (or any part thereof), enter a sweepstakes or contest offered by us, communicate with our support personnel, respond to a survey or marketing promotion, or otherwise communicate with us (including, but not limited to, via email or phone), you may provide us with certain information, including personal information.  Such information may include, but is not limited to, your name, phone number, credit card or other billing information, email address and mailing address. Personal Information also includes your IP address or other unique identifier (“Device Identifier“) that is associated, on a persistent or on-going basis, with your computer, mobile phone or other device (any “Device“) you use to access the Services.  Personal information may also include when you choose to provide ratings, taste preferences, account settings including items like, but not limited to PIN number, password, or otherwise provide information to us through our Services or elsewhere.  

 

  • Information from Social Media Networks and other Third Parties:  We may obtain information (which may include personal information) about you via sources that are not us, including, but not limited to the Internet, offline sources, social media services (e.g. Facebook, Instagram, Pinterest, YouTube), advertising or marketing platforms, various service providers that exclusively provide support to our Services, or other public or commercial sources.  Examples of Third Parties we may utilize would be:
    • Service providers that help us determine a location based on your IP address in order to customize our Services or enforce our Terms of Service. 
    • Payment service providers who process your payment and detect and prevent fraud.  
    • Social Media Networks when you elect to use a social media function such as a “share” button.  Doing that could enable us to obtain information from the social media platform. That information could include your friends or contacts, profile picture, birth date, gender, people/sites you follow, or other profile-related information, as well as any other information you have opted to share. The information we obtain from social media networks depends on your account/privacy settings with those third parties and those third-parties’ privacy policies, so be sure to check those policies and to adjust your settings to meet your preferences.

 

  • Information we collect automatically:  When you use our Services, we and our third-party service providers automatically collect certain information about your use of the Services.  This information includes information about the devices used to access the Services, such as Internet Protocol (“IP”) address, your device ID and other unique device identifiers, mobile network or internet service provider information, information about how the device is interacting with our Services, hardware model, and the type and version of your device’s operating system or web browser.  We also collect information about how you use our Services, such as pages viewed and the order of such pages, content (including video content) you view within the Services; payment history; correspondence with us; the length of time you interact with the Services; search queries entered within the Services; error logs; websites and other services you visit before and after visiting our websites; and other similar information.  Much of this information is collected through cookies, web beacons, and other tracking technologies.   • Information you provide about others:  We may also give you the ability to provide us with your contacts’ information, for example, to gift a subscription to the Service or to recommend.  If you use such features, we may use and store your contacts’ details, including, but not limited to, to deliver the offer to your contacts. You are responsible for getting your contacts’ permission when you opt to give their contact details to us.  Please be aware that when you use this type of functionality on our Services, your name and e-mail address may be included in the communication sent.

3. How we use the information we collect

 

We use information to provide, analyze, administer, enhance and personalize our services and marketing efforts, to process your registration, your orders and your payments, and to communicate with you on these and other topics.  We also may use the information we collect for fundraising to support our mission.  For example, we may use the information to:

  • Determine your general geographic location, provide localized content, provide you with customized and personalized viewing recommendations for movies and TV shows we think will be of interest to you, provide a seamless experience across platforms and devices, determine your Internet service provider, and help us quickly and efficiently respond to inquiries and requests;
  • Prevent, detect and investigate potentially prohibited or illegal activities, including fraud, and to enforce our terms (such as determining free trial eligibility);
  • Analyze and understand our audience to:
    • improve our service (including our user interface experiences)
    • optimize content selection
    • recommendation algorithms
    • create profiles about you including adding and combining information we obtain from third parties which may be used for analytics and marketing
    • optimize Services performance and delivery;
  • Provide technical and other support, including to understand and resolve technical issues with the Services or operational requests such as password reset requests.
  • Communicate with you concerning our service so that we can send you news about Pure Flix, details about new features and content available on PureFlix.com, surveys, special offers or promotional announcements by us, our partners and other organizations with which we work. These communications may be by various methods, such as email, push notifications, text message, online messaging channels, and matched identifier communications (described below).  If you do not wish to receive these communications (which may occur via email), you may opt-out by clicking the “unsubscribe” link or following the instructions included in such communications. Please note, however, that you cannot opt-out of certain administrative communications. 4. When we share information

 

Pure Flix is committed to maintaining your trust.  We don’t sell or rent your information to others. We may disclose your information for certain purposes and to third parties, as described below:

  • Authorized Service Providers: We use other companies, agents or contractors ("Service Providers") to perform services on our behalf or to assist us with the provision of services to you. For example, we engage Service Providers to provide marketing, advertising, communications, hosting and infrastructure, technology (including video and audio players, operating systems and platforms and IT services), to personalize and optimize our service, to assist with customer service, to collect debts, to analyze and enhance data (including data about users' interactions with our service), and to process and administer consumer surveys.  We only disclose the information necessary to enable these third parties to perform their services. In the course of providing such services, these Service Providers may have access to your personal or other information. We do not authorize them to use or disclose your personal information except in connection with providing their services.
  • Payment partners:  We use specialist payment partners to process your payment card information.  In processing your payments, they may also use the data for fraud detection and prevention.  They’re obligated to remain certified as compliant with the Payment Card Industry (PCI) security standards. 
  • Promotional offers:  We may offer joint promotions or programs that, in order for your participation, will require us to share your information with third parties. In fulfilling these types of promotions, we may share your name and other information in connection with fulfilling the incentive. Please note that these third parties are responsible for their own privacy practices. 
  • Social sharing:  To allow social sharing of content or materials, which may be through Third Party Service(s).
  • Business Transfer: In the event we go through a business transition such as a merger, acquisition, bankruptcy, reorganization, or sale of all or a portion of our assets, or a diligence process in connection with a potential business transaction, the information we collect and maintain may be disclosed, sold, or transferred as part of that transaction, provided that the receiving party agrees to respect your personal information in a manner that is consistent with our Privacy Policy.  If such transfer is subject to additional restrictions under applicable laws, we will comply with such restrictions.  
  • Legal requirements and protection of Services and members:  We will disclose the information we collect where we have a good faith belief that such disclosure is: (a) required by law (or to respond to subpoenas, warrants, government requests, or similar process served on us); (b) pursuant to our DMCA notice and take-down policy and procedures; and/or (c) necessary to protect or defend our legal rights or property, our Services, you, or other third parties, or ensure the safety and security of our Services, systems, and of our customers or the general public.
  • Aggregate information:  We may aggregate and/or de-identify information such that it is no longer linked to you or your device.  This Privacy Policy does not limit our ability to disclose aggregated or de-identified information that is not linked to you.   We may use and disclose such information at our discretion.

5. Updating your information and control of your Data

 

We give you access and the ability to update information about your account, including your contact information and your Payment Choice in the "Account" portion of our website. You must be signed in to access "Account." 

You may “opt out” of receiving future e-mail communications from us by clicking the “unsubscribe” link or following the other instructions included at the bottom of most e-mails we send, provided, however, we reserve the right to continue to send you transactional e-mails, such as customer service communications, administrative messages, service announcements, and messages regarding the terms and conditions of your account because those may contain important information.

6. How we use cookies and other tracking technologies

We and our Service Providers use cookies and other technologies (such as web beacons), as well as resettable device identifiers, for various reasons.  For example, we use these technologies for such purposes as determining your general geographic location, providing localized content, enforcing our terms (such as determining your eligibility for a free trial), providing recommendations on movies & TV shows we think will be enjoyable, personalizing the service and our marketing to better reflect particular interests, tracking your instant-watching hours, determining your Internet service provider, helping us quickly and efficiently respond to inquiries and requests and otherwise analyzing, enhancing, administering or promoting our service offering for you and other users. We may supplement this information with information from other sources, including offline data and your browsing behavior on other sites and interactions with our advertising. We also provide analysis of our users in the aggregate or otherwise in anonymous form to prospective partners, advertisers and other third parties. We may also disclose and otherwise use, on an anonymous basis, movie & TV show ratings, consumption habits, commentary, reviews and other information. For example, we use movie & TV show ratings and consumption behavior to improve our recommendations to you as well as other users.

  • What are cookies? 

Cookies are small data files that are commonly stored on your device when you browse and use websites and online services. They are widely used to make websites work, or to work more efficiently, as well as to provide reporting information and assist with service or advertising personalization.

  • What are resettable device identifiers?

    • Essential cookies: These cookies are strictly necessary to provide our website or online service. They also help us to enforce our Terms of Use, prevent fraud and maintain the security of our service. 
    • Performance and functionality cookies: These cookies are not essential, but help us to personalize and enhance your online experience with Pure Flix. For example, they help us to remember your preferences and prevent you from needing to re-enter information you previously provided (for example, during member sign up).     • Advertising cookies and resettable device identifiers: These cookies and resettable device identifiers use information about your use of this and other websites and apps, your response to ads and emails, and to deliver ads that are more relevant to you.   • How Does Pure Flix use Web Beacons and other Technologies? 

Web beacons (also known as clear gifs or pixel tags) often work in conjunction with cookies. We and our Service Providers may use them for similar purposes as cookies, such as to understand and enhance the use of our service, improve site performance, monitor visitor traffic and actions on our site, and understand interactions with our marketing (including email and online ads on third party sites). 7. Children

 

PureFlix cares about protecting the privacy of children.  If you are a parent or guardian, we encourage you to become involved in your children’s online experience, and to share your knowledge and experience with your young ones.  If you are under 13, please do not register for our Service or provide us with any contact or other information, including your name, postal address or email address. You must be 18 years of age or older to subscribe to the Pure Flix service. In certain jurisdictions, the age of majority may be older than 18, in which case, you must satisfy that age in order to become a member. While individuals under the age of 18 may utilize the service, they may do so only with the involvement, supervision, and approval of a parent or legal guardian, and subject to our Terms of Use.

8. How we maintain and secure the information we collect

 

Pure Flix takes information security seriously and uses reasonable administrative, technical, physical and managerial measures to protect your personal information from unauthorized access. For example, we utilize token technology and Secure Sockets Layering (SSL), an industry-standard protocol for certain of your transmissions to us, in order to encrypt certain personal information that you send to us through the registration and sign up process.

Unfortunately, no security system can be guaranteed to be 100% secure. Accordingly, we cannot guarantee the security of your information and cannot assume liability for improper access to it. By using our service, including our website and user interfaces, or providing information to us through any means, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Pure Flix service.

In order to provide you with ease of access to your account and to help administer the Pure Flix service, Pure Flix implements technology that enables us to recognize you as the account holder and provide you with direct access to your account without requiring you to retype any password or other user identification when you revisit the Pure Flix service. You can choose not to take advantage of this feature on your computer by unchecking the box "Remember me on this computer" when you login on the website and also clearing the passwords and cookies from your computer. To remove access to your Pure Flix account from your devices: (a) visit Your Account (note, deactivation may not occur immediately) or (b) delete your Pure Flix settings from your device (steps vary by device and the option is not available on all devices). You are responsible for maintaining the confidentiality of your account access information and for restricting access to your computer or device through which you access your Pure Flix account. Where possible, users of public or shared devices should log out at the completion of each visit and not check the "Remember me on this computer" when logging in to Pure Flix. If you sell or return a computer or Pure Flix ready device, you should log-out of the device before doing so and/or set the device back to its factory setting. If you do not maintain the security of your password or device, or fail to log out or deactivate your device, subsequent users may be able to access your account, including your personal information.

Pure Flix respects the privacy of all our Members.  As a non-profit organization and that we do not sell any data, CCPA is not applicable to our Services.  Regardless, and to demonstrate our commitment to maintaining your trust, California residents can request and obtain from us once a year and free of charge a list of third parties to which Pure Flix has disclosed certain information during the preceding calendar year to support our marketing purposes. 13. Pure Flix Netiquette Policy

On behalf of Pure Flix, we are thrilled that you have chosen to take the time to engage in and share your knowledge and life experience with our online community.  We encourage our community to be respectful and professional at ALL times, bearing in mind that your words can either lead a person towards Christ or away from Christ. Remember, to many, you are a reflection of the God you serve and the faith you profess. It goes without saying that no foul language, flaming wars, or spamming will be tolerated and an instant deletion of those comment(s) will occur.

Members and visitors to our community are welcome and are invited to abide by the following guidelines:

  1. Be Respectful of Other's Ideas, Opinions, and Beliefs. It's fine to disagree with someone, but please respect their right to think differently.
  2. Avoid Sarcasm. People can easily misinterpret intent.
  3. Use Appropriate Language. Avoid profane, coarse, rough, rude, condescending or insulting language.
  4. Use Appropriate Salutations. Refer to others by their internet handles. Absolutely No Name-calling.
  5. Observe Good Grammar and Spelling.  Generally accepted IM Shorthand and Chat acronyms are accepted unless an abbreviation or acronym refers to a profane word or phrase. Also, please be aware that the Autocorrect tool can replace words you did not intend to convey.
  6. Avoid “Flaming” (Online Screaming). Do not type sentences in all caps. These messages may be subject to deletion at our discretion.
  7. No Spamming. Spamming is defined as sending unwanted advertising messages or the same electronic message over and over. These messages may be subject to deletion at our discretion.
  8. Use the Same Etiquette and/or Behavioral Courtesies as You Would in Person. Treat others as you would want to be treated.
